5. Terms of Sale

By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price. Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or any unforeseen failures to deliver which we will not be responsible. In order to contract with Minimax you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. Minimax retains the right to refuse any request made by you.


a. Our Contract

 

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until goods have been shipped.


b. Pricing and Availability

 

All prices stated are in Australian dollars.

 

GST (Goods and Services Tax) of 10% is inclusive in all our prices.

 

Prices of products, service, delivery and other charges displayed on this website are current at the time of issue, but are subject to change at any time. If stock is unavailable, a customer service representative will be in contact regarding this.

 

Accessories and food items used for styling and display purposes in photographs are not for sale with the product.

 

Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur.


c. Colour Availability

 

While we will endeavour to supply to you the colour that you have ordered, for some smaller items this is not always possible due to the fast turnover of product.


d. Payment

 

Upon receiving your order we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfil the transaction. Goods will not be dispatched until this pre-authorisation check has been completed. Your card will be debited once the order has been accepted. All products remain the property of Minimax until your order has been processed and dispatched.

9. Governing Law and Jurisdiction

These terms and conditions are to be construed in accordance with the laws of Victoria, Australia and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of Victoria, Australia.

10. Entire Agreement

The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and Miniamax. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by a Director of Minimax.

The Mornington Table Promotion

Promotion Period: Monday 27th April 2026 to Sunday 7th June 2026

IMPORTANT: This promotion includes alcoholic beverages as part of the major prize. Entry is open to Australian residents aged 18 years or older only. Proof of age may be required.

1. The Promoter

The promoter of this competition is Minimax PTY LTD ABN 45 107 595 577, located at 24 Sixth Avenue, Burwood, Victoria ("Promoter").

 

2. Eligibility

2.1 To enter this promotion, participants must:

  • Be an Australian resident aged 18 years or older at the time of entry.
  • Be a registered member of the Minimax Rewards program.
  • Make a qualifying purchase (see clause 3) at Minimax Mornington during the relevant promotion period.

2.2 The following persons are ineligible to enter:

  • Employees, contractors, and immediate family members of Minimax PTY LDT and any associated agencies involved in the promotion.
  • Persons under the age of 18 years.
  • Persons who do not hold a valid Minimax Rewards membership.

2.3 Age verification: The major prize includes wine pairings and alcoholic beverages. By entering, participants confirm they are 18 years of age or older. The Promoter reserves the right to request proof of age (e.g. driver's licence, passport) before issuing any prize. If a winner cannot provide satisfactory proof of age, the prize may be forfeited.

 

3. How to Enter

3.1 The promotion runs for six (6) consecutive weeks. A separate draw is conducted each week. The major draw is completed at the end of the six-week campaign. 

3.2 To receive one (1) entry into the weekly draw, eligible participants must:

  1. Be a registered member of Minimax Rewards; and
  2. Make a single transaction purchase of $75.00 or more (excluding gift cards, layby payments, loyalty redemptions, and any other excluded products as determined by the Promoter) in-store at Minimax Mornington during that week's promotion period.

3.3 Each qualifying transaction of $75.00 or more in a single transaction earns one (1) entry. Multiple transactions in the same week will accumulate entries as long as each individual transaction meets the $75.00 threshold.

3.4 Entries are non-transferable and cannot be exchanged for cash.

3.5 The Promoter is not responsible for entries lost, delayed, or not received due to technical issues or any other reason outside the Promoter's reasonable control.

 

4. Weekly Promotion Periods & Prizes

4.1 Each week's promotion period, draw date, and corresponding prize are set out below. All times are Australian Eastern Standard Time (AEST).

4.2 RRP figures are approximate and provided in good faith. The Promoter does not warrant the accuracy of RRP figures.

4.3 Entry into one week's draw does not carry over to subsequent weeks. A new qualifying purchase is required each week to enter that week's draw.

 

5. Major Prize

5.1 In addition to the six (6) weekly prizes, one (1) Major Prize will be drawn at the conclusion of the promotion period. All eligible entrants across all six (6) weeks will be entered into the Major Prize draw to the value of approximately $3,750

5.2 The Major Prize comprises:

  • A private dining experience for the winner and their nominated guests, prepared by local chef Wyn Davies using local Mornington Peninsula ingredients.
  • Wine pairings sourced from a Mornington Peninsula winery ([name to be confirmed]) — included for guests aged 18 years or older only.
  • An elegantly styled table with products as listed below from Minimax, and floral arrangements by Poppy Culture, which the winner retains following the event.

5.3 Alcohol and the Major Prize:

  • Wine pairings form part of the Major Prize experience. As such, entry into this promotion is restricted to persons aged 18 years or older in compliance with Victorian liquor licensing laws.
  • Any guests attending the dining experience who are under 18 years of age will not be served alcohol. The winner is responsible for ensuring minors in their party do not consume alcohol.
  • The Promoter and venue reserve the right to refuse service of alcohol in accordance with applicable liquor licensing legislation.

 

5.4 The number of guests included in the Major Prize dining experience is 6. Any additional guests are at the winner's expense.

5.5 The dining experience date, time, and location will be arranged by the Promoter in consultation with the winner. The winner must be available within 3-months of the draw date. Failure to confirm a mutually agreeable date within this period may result in prize forfeiture.

5.6 Two (2) runners-up in the Major Prize draw will each receive a $300 Minimax gift voucher. Gift vouchers are not redeemable for cash and are subject to standard Minimax gift voucher terms and conditions.

 

6. Prize Draws

6.1 Weekly draws will be conducted at 24 Minimax Support Office, Sixth Avenue, Burwood, Victoria on each Monday following the close of each week's promotion period.

6.2 The Major Prize draw will be conducted at Minimax Support Office, 24 Sixth Avenue, Burwood, Victoria on Wednesday 10th June 2026, following the close of Week 6.

6.3 Draws will be conducted using a computerised random selection process, or such other method as the Promoter deems appropriate to ensure a random and verifiable outcome.

6.4 The Promoter's decision in relation to all aspects of the promotion is final. No correspondence will be entered into.

 

7. Winner Notification & Claiming Prizes

7.1 Weekly prize winners will be notified by email, within 3 business days of the draw.

7.2 The Major Prize winner and runners-up will be notified by email within 3 business days of the Major Prize draw.

7.3 Winners must respond and confirm acceptance of the prize within 14 days of notification. If a winner does not respond within this period, the prize may be forfeited and a redraw conducted.

7.4 Prizes must be claimed in accordance with the Promoter's directions. The Promoter is not responsible for prizes lost or damaged in transit.

7.5 Winners of the Major Prize may be required to participate in reasonable publicity activities (e.g. photographs, social media mentions) at the Promoter's request. Participation is subject to the winner's consent.

 

8. Prize Conditions

8.1 Prizes are subject to availability, and the Promoter reserves the right to substitute any prize with a prize of equal or greater value if the advertised prize becomes unavailable.

8.2 Prizes are not transferable, not exchangeable, and cannot be redeemed for cash unless otherwise specified by the Promoter.

8.3 All prizes must be accepted as offered. The Promoter accepts no responsibility for any variation in prize value.

8.4 Any costs associated with prize acceptance that are not expressly stated as included (including but not limited to transport to/from the dining experience, accommodation, and additional guests) are the sole responsibility of the winner.

8.5 Prize images are for illustration purposes only.

 

9. Privacy

9.1 Personal information collected from entrants will be used by the Promoter for the purpose of conducting this promotion, including contacting and identifying winners.

9.2 By entering, participants consent to the Promoter using their personal information in accordance with the Promoter's Privacy Policy, available at minimax.com.au.

9.3 Personal information will not be disclosed to third parties except as required to fulfil the prize or as required by law.

9.4 Participants may request access to, or correction of, their personal information by contacting the Promoter at customercare@minimax.com.au.

 

10. Liability & General Conditions

10.1 To the extent permitted by law, the Promoter excludes all liability for any loss, damage, or injury (whether direct or indirect) arising from participation in this promotion or acceptance of a prize.

10.2 If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated, the Promoter reserves the right to modify, suspend, or cancel the promotion, subject to any applicable regulatory approval.

10.3 The Promoter is not responsible for any technical failures, including but not limited to malfunctions of computer hardware, software, internet connections, or any other technology required to participate.

10.4 Nothing in these Terms and Conditions limits, excludes, or modifies any consumer guarantee, warranty, or right that cannot be excluded under applicable law, including the Australian Consumer Law.

 

11. Governing Law

11.1 This promotion is conducted in accordance with the laws of the State of Victoria, Australia.

11.2 This promotion is a game of chance. Skill plays no part in determining winners.

11.3 This promotion complies with the Liquor Control Reform Act 1998 (Vic) and all applicable Victorian liquor licensing legislation regarding the inclusion of alcohol in prizes.
